Ed Sheeran Wins ‘Thinking Out Loud’ Copyright Trial
A New York City jury found that the singer was not liable for infringing on Marvin Gaye's "Let's Get It On"
Ed Sheeran has been found not liable in the copyright lawsuit trial that accused his song “Thinking Out Loud” of infringing on Marvin Gaye’s “Let’s Get it On.”
After three hours of deliberations that followed a two-week trial in New York, the jury announced their verdict Thursday in favor of Sheeran, finding that he independently created his 2014 single and did not copy Gaye’s hit.
While Sheeran was pleased with the outcome (he won’t have to retire now, as he threatened during his testimony), he said in a post-trial statement that he “unbelievably frustrated that baseless claims like this are allowed to go to court at all. “It’s simply wrong. By stopping this practice we can also properly support genuine music copyright claims so that legitimate claims are rightly heard and resolved,” he added, calling the lawsuit against him a “bogus claim.”

Personally, I'm pleased that someone has won over the parasites relating to Marvin Gaye's Estate after their successful attempt at playing the man over the ball worked in the ridiculous 2015 "Blurred Lines" case in which they were victorious over Robin Thicke & Pharrell Williams mega hit. I guess this time their lawyers attempts at playing the race card failed to impress on this jury. Not least as the chord sequence is as old of time having been used in loads of earlier tracks prior to Marvin Gaye's 1973's mega hit. Not least a certain 1970 Van Morrison track which Ed Sheeran admitted he was inspired by in creating "Thinking Out Loud"; but more importantly in a 1973 Billboard magazine interview, Marvin Gaye admitted himself he sexed up the same 1970 Van The Man composition for LGIO:

Good, like you say the Marvin Gaye song was a rip off and there are only so many chords sequences, pop music all uses the same chords, it's madness, literally all music of this type has been done before a million times and in this case the "original" had already been done a thousand times

I'm glad he won as it would have opened the floodgates for anybody to make a claim against songwriters whose songs may sound similar to theirs. There is very little artwork that is 100% original. Nearly everything is a mish mash of existing ideas - that's what keeps things evolving.

Agreed; this was the correct outcome. Can't help but notice that this coincides beautifully with the release of his new album... I'm sure Ed was absolutely delighted it coincided with his Grandmother's funeral so he had to miss it, and caused him to abandon two weeks of scheduled promo for "Subtract" to attend the ridiculous court case. Rolls Eyes.

The most ridiculous music copyright trial (in reverse) where what I, and most people at the time thought was an open & shut slam-dunk case, but incredibly lost was when (the singer/songwriter Eddy Grant of) this 1970 single took on a huge hit song from a quarter of a century later:

If you listen to that (especially from the opening 10 seconds) I really don't need to tell you what the huge #1 hit song was which was unbelievably found not guilty of copyright infringement...

Problem is the basic idea of both of those songs is very basic - and in between there's "Spanish Bombs" by The Clash which is like the b*st*rd offspring of the two...it's an example of how limited the pop palette can be.

Had no idea about his grandmother's funeral. That obviously is very sad. He'll probably get over the promo. The previous court case (over Shape Of You) coincided with the funeral of a close friend. His warm-up gig in Brighton was moved from the Friday evening (the day 0f the funeral) to Saturday afternoon as a result. Leaving a March gig in daylight and on a warm day felt very weird.
